New Rhode Island Laws Recently Passed

Refusal to Submit to Chemical Test...Don't Hold Your Breath

Do you know that there is a newly amended law in Rhode Island (RI General Law 31-27-2.1) for those who refuse to submit to a chemical test to determine their blood alcohol level that results in:

First Offense:

  • Driving license suspended six months to one year
  • $200 to $500 fine
  • Up to 60 hours of community service
  • Attendance at a special course on driving while intoxicated and/or alcohol or drug treatment

Second Offense:

  • $600-$1000 fine
  • 60 to 100 hours of community service
  • Required alcohol and/or drug treatment
  • Shall be guilty of a misdemeanor
  • Imprisonment up to 6 months

Third Offense:

  • Driving license suspended two to five years
  • $800-$1000 fine
  • Not less than 100 hours of community service
  • Required alcohol and/or drug treatment
  • Shall be guilty of a misdemeanor
  • Imprisonment up to one year

Furnishing Alcohol to Minors...Adults Beware!

Did you know…that there are newly amended laws in Rhode Island (RI General Laws 3-8-11.1 and 3-8-11.2) that holds the adult responsible for permitting the use of alcohol by minors under their supervision?

  • If you permit or knowingly furnish alcohol to a minor in your home you could be jailed up to 6 months, fined between $350 to $1000, and/or be charged with a misdemeanor on the first offense
  • That a second violation includes fines of not less than $750 to $1000 and you could be jailed up to 6 months and charged with a misdemeanor
  • The third violation includes a fine not to exceed $2500, charged with a felony and possible imprisonment for one-year
  • That the legal drinking age in Rhode Island is 21 for a reason
